Brazil now has a National Policy on Critical and Strategic Minerals. The Critical Minerals Association — AMC, an organization that brings together companies engaged in the exploration, development, and operation of critical mineral projects in Brazil, recognizes the priority given to this agenda by the National Congress and the Federal Government, as it represents a historic opportunity to expand the country’s participation in the global value chains of the energy transition, food security, and digital transformation.
AMC highlights the important instruments established under the new Law, including the Guarantee Fund, the Federal Mineral Processing and Transformation Program, the Low-Carbon Mineral Certificate, incentivized debentures, and the strengthening of research, development, and innovation policies.
International experience shows that the effectiveness of a legal framework depends directly on the quality of its regulation. It is at this stage that the procedures, criteria, and mechanisms capable of ensuring clarity, predictability, and legal certainty for its implementation and for decision-making by domestic and foreign investors will be defined.
Therefore, regulation will be essential to transform the mechanisms established under the Policy into concrete results. Technical and objective criteria, transparency, predictability, and proper coordination among the competent authorities will help strengthen Brazil’s competitiveness and create a favorable environment for increased investment.
AMC is fully mobilized and available to the Federal Government to continue actively cooperating in the regulation and implementation of the Policy, making its technical, business, and international expertise available. The Association and its member companies reaffirm their commitment to the responsible development of the mining sector and to building a critical minerals value chain capable of generating investment, innovation, jobs, and economic development for the country.
Brazil has a unique opportunity ahead. Regulation built through dialogue, technical criteria, predictability, and a long-term vision will be decisive in transforming Brazil’s mineral potential into investment, industry, innovation, and development.
